Delhi High Court Quashes Case After Settlement

The Delhi High Court has quashed a case filed by one plane passenger against a co-passenger for allegedly staring at her persistently, causing discomfort.
The Court was considering a Writ Petition seeking quashing of an FIR under Sections 509 of the Indian Penal Code and all proceedings emanating therefrom on the basis of settlement between the parties.
The single bench of Justice Ravinder Dudeja observed, “In view of the settlement between the parties, learned Additional PP appearing for the State, also has no objection if the present FIR No. 370/2024 dated 29.05.2024, Under Sections 509 of the Indian Penal Code registered at P.S. IGI Airport along with charge sheet is quashed.”
The Petitioner was represented by Advocate Anubhav Mehrotra while the Respondent was represented by Additional Standing Counsel Sanjeev Bhandari.
The Petitioner alleged that co-passenger stared at her persistently, causing discomfort. She submitted a written complaint to the police upon landing. Based on the complaint, FIR under Section 509 IPC was registered.
During the proceedings, the parties have amicably resolved their disputes and executed a Settlement Agreement.
The Court referred to the Supreme Court’s ruling in Gian Singh vs State of Punjab wherein the Court had recognized the need of amicable resolution of disputes.
It thus noted, “Respondent No.2 confirms that the matter has been settled with the petitioner without any force, fear, coercion and she further submits that she has no objection if the FIR No. 370/2024 dated 29.05.2024, Under Sections 509 of the Indian Penal Code registered at P.S. IGI Airportis quashed against the petitioners.”
The Petition was accordingly disposed of.
