Kolkata: The Calcutta High Court has left it to the trial court to decide on a request from the parents of the murdered RG Kar Hospital doctor, who are seeking permission to visit the crime scene.
Represented by counsel Phiroze Edulji, the parents requested access to inspect the site of the incident, excluding the seminar room where their daughter’s body was discovered on August 9, 2024.
In response to the widespread opposition and protests following the on-duty doctor’s rape and murder within the hospital premises, the High Court had transferred the investigation from the Kolkata Police to the Central Bureau of Investigation (CBI).
Justice Tirthankar Ghosh, who heard the plea, noted that since the CBI is conducting further investigation and the ACJM, Sealdah, is handling the matter, no order can be issued without informing the magistrate.
Justice Ghosh stated that the petitioners could approach the ACJM court with their request, and directed that the ACJM must address such applications within 48 hours of submission.
Deputy Solicitor General Rajdeep Majumdar, representing the CBI, indicated that since the CRPF is responsible for security at the hospital, court authorization for such permission is necessary.
Senior Advocate Kalyan Banerjee, representing the West Bengal government, opposed the request, arguing that if the petitioners seek a reinvestigation into the doctor’s rape and murder, they should formally request to set aside the entire investigation and its implications from the outset.
He emphasized that the petitioners need to clarify whether they are pursuing further investigation or a completely new inquiry into the crime.
In a separate development, former civic volunteer Sanjay Roy has been sentenced to life imprisonment by the Sealdah sessions court after being found guilty of the crime.
The parents of the victim of a rape and murder case at R G Kar Medical College and Hospital last year have approached the Calcutta High Court for permission for their legal counsel to visit the crime scene.
Earlier, Their lawyer, On Monday this week sought an urgent hearing before Justice Tirthankar Ghosh, who granted permission for the matter to be officially filed.
The victim’s parents also expressed dissatisfaction with the CBI’s investigation and later approached the Calcutta High Court to request further inquiry.
The victim’s father claimed there were “procedural lapses in the course” of the investigation.
Earlier, The parents of the doctor who was raped and murdered at RG Kar Hospital approached the Calcutta High Court requesting a new investigation into the crime.
