AIMPLB Demands Action on Justice Shekhar Yadav’s Remarks, Flags Threat to Secularism

New Delhi: Today, on June 26, the All India Muslim Personal Law Board (AIMPLB) has written a formal letter to major political parties in the country, urging them to take necessary steps regarding controversial remarks made by Justice Shekhar Yadav of the Allahabad High Court during a speech delivered on December 8, 2024, within the court premises.

The Board expressed serious concern that the comments made by the judge go against the core values of the Indian Constitution and reflect a biased mindset.

In the representation addressed by the General Secretary of AIMPLB, Maulana Mohammed Fazlur Rahim Mujaddidi, the Board said that it was deeply disappointed by the silence of political leadership on this matter even six months after the incident.

The Board highlighted that the speech was not just inappropriate, but also seemed to show a personal or sectarian view disguised as a constitutional opinion.

The Learned Judge, the Board said,

“appears to have disregarded the constitutional stature of his office and spoken from a perspective shaped by personal beliefs rather than the inclusive spirit of India’s secular principles. Such remarks challenge the neutrality expected from the judiciary and threaten the Rule of Law.”

The Board pointed out that the Indian Constitution provides legal protection for all religious beliefs and cultural traditions, especially in areas such as personal laws.

It stated that in a country as diverse as India, such protections must not only be preserved but also respected by every organ of the State, including the judiciary.

The AIMPLB strongly felt that the Judge’s speech went beyond his constitutional role and instead sounded like it came from someone guided by individual or religious leanings.

The Board was particularly worried that if such incidents are ignored, it may send a wrong message and allow further erosion of judicial neutrality and secularism.

The letter continued to criticize the lack of reaction by political leaders, stating that their silence could

“set a dangerous precedent.”

It appealed to all political parties across the spectrum to step up and ensure that the values enshrined in the Constitution are protected.

The letter concluded,

“It is imperative that the political class initiates appropriate constitutional steps to uphold judicial neutrality and safeguard the secular character of the nation,”

The Board also reminded that the independence of the judiciary is important, but so is its impartiality. Judges must avoid making any statements that sound biased or are influenced by their personal thoughts, especially in public settings like court premises.
