Motor Vehicles Act (59 of 1988) , S.166— Motor accident – Injury claim – Enhancement of compensation – Claimant injured was skilled mason who suffered injuries in motor vehicle accident – Doctor had specifically deposed that claimant was unable to sit down and walk and could not lift heavy weights – Evidence of doctor indicated that claimant could not have continued his chosen vocation – Considering entire circumstances, functional disability of claimant was assessed at 35% – Income of Rs.6,000/- p.m. as claimed was accepted – Compensation awarded for permanent disability and loss of income was enhanced – Amount awarded towards medical expenses was enhanced -Amount awarded towards pain and suffering was enhanced – Claimant was entitled to enhanced compensation accordingly
