BJP MP Nishikant Dubey Moves Supreme Court Against FIR, Slaps Privilege Notice On Top Jharkhand Officials

BJP MP Nishikant Dubey has challenged the FIR lodged against him, moving the Supreme Court and filing a privilege motion against senior Jharkhand officials. The move escalates the political and legal tussle between the MP and the state administration.

Ranchi BJP MP Nishikant Dubey on Saturday announced that he has filed a case of privilege under Article 105 of the Constitution against the Jharkhand Chief Secretary, Director General of Police, Deoghar Deputy Commissioner, and Superintendent of Police. This comes in response to an FIR registered against him by Jharkhand Police.

According to Jharkhand Police, the FIR—lodged on Friday—names BJP MPs Nishikant Dubey, Manoj Tiwari, and others for allegedly “forcibly” entering the holy of the Baba Baidyanath Temple in Deoghar on August 2, which they claim hurt the religious sentiments of devotees.

Speaking to reporters in Deoghar, Dubey strongly objected to the FIR, stating,

“I am the trustee of Baba Baidyanath Dham Temple as a Member of Parliament, as per the law. I am a step ahead of the priest. At what basis the FIR was lodged.”

The BJP MP further revealed that he went to the Baba Mandir police station intending to surrender, but the police refused to arrest him.

“Dubey said that he reached Baba Mandir police station to court his arrest, but police denied his arrest.”

Highlighting the number of legal actions taken against him over the years, Dubey posted on social media,

“Fifty-one cases lodged against me. I have filed a case of privilege under Article 105 of the Constitution against the chief secretary, Director General of Police, Deoghar Deputy Commissioner and Superintendent of Police of Jharkhand.”
