Calcutta HC Declines Urgent Listing Of Contempt Plea Against State Continuing Recruitment Of OBC A & B Candidates Despite Stay On New OBC List

The Calcutta High Court has denied a plea to urgently list a contempt application filed against the West Bengal government’s alleged decision to continue with the recruitment process consisting of OBC A and B category candidates, despite the High Court’s order staying the government notification to begin the process of identifying new OBC classes, after it had struck down all OBC classes notified after 2010.
The plea was mentioned by Senior Advocate Bansuri Swaraj.
“On 17th June, milords had stayed five notifications in the OBC matter…very strangely, the state in violation of the order is still continuing the recruitment process in OBC A and B categories, I am seeking to have a hearing this week…71,000 applications have been received as of 18th June. The subterfuge here is to ensure that so many people apply that in case milords decision is not in favour, they will create an irreversible position,” she submitted.
Upon hearing the mentioning, the bench remarked, “What is the urgency? We cannot stop admission now…it will come up on the returnable date. This way it cannot be listed. Where is your notice to the other side? Come back and mention.”
Thus, the court declined to list the matter urgently and asked the counsel to come back later.
