Civil Court Defers Hearing To August 21 Amid Bar Strike

The Chandausi civil court has postponed the Shahi Jama Masjid-Harihar temple case to August 21 due to a lawyers’ strike. The case involves claims that the mosque stands over a pre-existing Hindu temple.

A civil court in Chandausi has postponed the hearing in the ongoing Shahi Jama Masjid-Harihar temple dispute to August 21. The delay happened because members of the local bar association were on strike on Tuesday.

The case was scheduled for a hearing before Civil Judge (Senior Division) Aditya Singh. However, due to the strike, no proceedings could take place. Advocate Shri Gopal Sharma, who is representing one of the parties, said,

“Due to the bar association strike today, the court has fixed August 21 as the next date of hearing.”

The other side’s Lawyer, Advocate Shakil Ahmad Warsi, Confirmed the Reason for the adjournment. He Statted,,

“Due to rains the bar association was on strike due to which the matter was posted for another date.”

This case has already been challenged in the Allahabad High Court by the Muslim side. They had questioned whether the case should be allowed to continue at all.

However, on May 19, the High Court rejected that objection and supported the decision of the lower court.

The High Court gave permission for a court-monitored survey and also ordered the Chandausi civil court to continue the hearing.

The High Court’s previous stay order was removed on May 19, and the relevant documents related to that decision were submitted to the trial court soon after.

The origin of this legal dispute goes back to November 19 last yearwhen Hindu petitioners, including lawyers Shankar jain day and Vishnu shankar jainfiled a suit in the Sambhal district court. They claimed that the Shahi Jama Masjid was constructed over a pre-existing Harihar temple.

On the very same day (November 19), the court ordered a survey of the site. A second survey was also conducted just five days later, on November 24.

The second survey led to widespread tension and unrest in Sambhal. Violent incidents broke out that tragically resulted in the death of four persons and injuries to 29 police personnel.

Following the violence, the police registered an FIR against SP Member of Parliament Ziaur Rahman Barq and Zafar Ali, who is the head of the mosque committee. Additionally, an FIR was lodged against 2,750 unidentified persons in connection with the violence.
