New Delhi: Today, on June 25, the Delhi High Court asked the Delhi Police to file their reply on the bail application of former Aam Aadmi Party (AAP) MLA Naresh Balyan, who has been arrested under the Maharashtra Control of Organised Crime Act (MCOCA).

The court, while hearing the matter, issued a formal notice to the police and fixed the next date of hearing for July 3.

The case was heard by Justice Manoj Jain, who directed that a notice be sent to the Delhi Police so they could present their response regarding the bail request.

In addition to the regular bail plea, Naresh Balyan has also asked for interim bail citing his health condition.

Considering this, the Delhi High Court further asked the superintendent of the jail to provide two important documents – the nominal roll (which includes details about the prisoner such as sentence, conduct, and time served) and a detailed report on the current medical status of Naresh Balyan.

The court gave the following directions during the proceedings:

“issued notice to Delhi Police on Balyan’s bail plea and posted the hearing on July 3”, and also instructed, “the superintendent of jail to send Balyan’s nominal roll and a report on his medical status”, since the former MLA has “sought interim bail on health grounds.”

The arrest of Naresh Balyan under MCOCA indicates the gravity of the charges against him, as this law is specifically used to target organised crime syndicates and criminal networks.

However, the former legislator has moved the court seeking relief from jail citing medical concerns, and the court has shown willingness to consider this by asking for a medical report before making a decision.

Background of the Case

Naresh Balyan, a former Member of the Legislative Assembly (MLA) from the Aam Aadmi Party (AAP), has been arrested under the Maharashtra Control of Organised Crime Act (MCOCA), a stringent law aimed at tackling organised crime and criminal networks.

His arrest is linked to an ongoing investigation involving alleged criminal activities and associations with an organised gang.

The exact nature of the allegations has not been publicly detailed, but the use of MCOCA suggests the case involves serious charges beyond regular criminal offences.

Following his arrest, Balyan moved the Delhi High Court seeking bail. Along with the regular bail plea, he also filed an application for interim bail on medical grounds, claiming that his health condition requires urgent attention outside of jail custody.

The Delhi High Court has now issued notice to the Delhi Police to file their response and has directed the jail authorities to submit Balyan’s nominal roll and a detailed medical report to assess his request for interim relief. The next hearing in the matter is scheduled for July 3, 2025.
