Ahmedabad: Today, On May 12, In a sensitive and significant judgment, the Gujarat High Court has allowed a 13-year-old rape survivor from Rajkot to medically terminate her 33-week pregnancy.

The High Court’s decision came after a special POCSO (Protection of Children from Sexual Offences) court had earlier rejected her plea for abortion.

The minor girl, who became pregnant due to repeated sexual assault by her neighbour, had approached the High Court seeking urgent medical relief.

The rapes reportedly occurred when her mother and stepfather were away at work.

The girl’s family came to know of the pregnancy after she started showing signs, following which legal and medical help was sought.

Justice Nirzar Desai of the Gujarat High Court heard the case and closely examined the medical condition of the girl.

Doctors submitted their opinion to the court, confirming that although the pregnancy had crossed 33 weeks, abortion was still medically possible.

However, the procedure carried serious risks because the girl was suffering from anemia.

Justice Desai observed:

“The medical opinion indicated that termination of pregnancy is possible though the procedure carries high risk of complication as the girl suffers from anemia.”

After evaluating all aspects—including the girl’s young age, her physical and mental health, and the trauma she had undergone—Justice Desai decided to grant permission for the medical termination of pregnancy.

The court emphasized that continuing the pregnancy would severely affect the child’s mental and physical well-being.
