Former CJI DY Chandrachud supported the Uniform Civil Code, saying the Constitution desires it. He urged inclusive implementation by taking all communities into confidence.
Mumbai: On Saturday, former Chief Justice of India (CJI) DY Chandrachud expressed his support for the implementation of a Uniform Civil Code (UCC) in India. While speaking to reporters in Mumbai, the 65-year-old former CJI said that the Indian Constitution clearly shows that having a UCC is a goal the country should work towards.
However, Justice Chandrachud also emphasized that this law should not be brought in suddenly or without considering the feelings and concerns of all communities and people in the country.
He explained that the implementation of the Uniform Civil Code must be done in a way that includes everyone and is clearly in the best interest of all citizens.
Quoting him, he said,
“I said what I have to say, which is that the Constitution expresses the desirability of a Uniform Civil Code. I said that it is important for us, at least 75 years after the birth of the Constitution and the founding of the Constitution, to realise this ambition and goal of the Constitution.”
He further added,
“But at the same time, by taking all segments of our society and community into confidence that this is truly in the interests of a future just Indian society which we need to create in the nation.”
The Uniform Civil Code is a proposal to have one common set of personal laws for all Indian citizens, no matter what religion, caste, or gender they belong to. These laws would deal with personal matters such as marriage, divorce, inheritance, adoption, and succession.
At present, people of different religions in India follow their own personal laws based on religious customs and traditions. For example, Hindus, Muslims, Christians, and Parsis have different rules for these matters.
The idea of a Uniform Civil Code is written in the Indian Constitution under Part IV, which deals with the Directive Principles of State Policy. Article 44 of the Constitution clearly states:
“The State shall endeavor to secure for the citizens a uniform civil code throughout the territory of India.”
This means that the Constitution encourages the government to work towards a UCC, but it is not mandatory.
The goal is to promote equality and unity among all citizens by making sure that personal laws do not discriminate based on religion, caste, gender, or other differences.
Currently, the UCC is only fully implemented in Goaand recently Uttarakhand has also taken steps towards adopting it. Many other states governed by the Bharatiya Janata Party (BJP) are also discussing its implementation.
The BJP-led central government under Prime Minister Narendra Modi has been in strong support of UCC. PM Modi has said many times that India needs a Uniform Civil Code to eliminate discrimination and ensure equal rights for everyone.

This statement by Justice Chandrachud is important because he is one of the most respected legal minds in India. His support for the UCC gives a strong push to the ongoing national debate.
At the same time, his call for an inclusive approach reminds lawmakers and citizens that the implementation must be done with care, ensuring that it truly benefits all Indians.
