Karnataka High Court Quashes FEMA Case Against Greenpeace Environment Trust Registered By ED

The Karnataka High Court has quashed a case registered against NGO Greenpeace by the Enforcement Directorate over alleged FEMA violations.

The Court was considering a Petition filed against the Show-Cause Notice issued for alleged omission of Section 6(3)(b) of the Foreign Exchange Management Act, 1999.

The Bench of Justice Suraj Govindaraj observed, “In that view of the matter, applying the dicta laid down by the Coordinate Bench of this court in its order dated 6.12.2025 passed in W.P. No.1418/2021, the above petition is require to be allowed.”

The Petitioner was represented by Advocate Monica Patil, while the Respondent was represented by Central Government Counsel Unnikrishan M.

The Court noted that there is no dispute about the position that the proceedings in the present matter had also been initiated after the omission of Section 6(3)(b) of the Foreign Exchange Management Act, 1999. and that a coordinate bench had allowed a plea arising out of a similar situation.

The Writ Petition was accordingly allowed.
