Kerala High Court admits petition, issues summons; next hearing in August.
Kochi: Today, on June 10, the Kerala High Court on Tuesday issued a legal notice to Congress leader Priyanka Gandhi Vadra in connection with a case filed by BJP candidate Navya Haridas. The case challenges Gandhi’s victory in the Wayanad Lok Sabha bypoll held in November 2024.
Justice K Babu of the High Court admitted the petition and, after listening to the arguments presented by Haridas’s lawyer, directed that summons be issued to Priyanka Gandhi.
The case will now come up for hearing in August.
Navya Haridas, who contested from Wayanad as a BJP candidate on November 13, 2024, came in third place.
The seat was won by Priyanka Gandhi Vadra with a huge lead of over 5 lakh votes. Communist Party of India’s candidate Sathyan Mokeri stood second.
In her petition, Haridas has made serious allegations against Gandhi. She claimed that Priyanka Gandhi Vadra did not disclose all her assets and properties as required under the law.
According to her, Gandhi failed to mention details of several immovable properties that are owned by her and her husband Robert Vadra.
She also pointed out that there were many movable assets and investments under Vadra’s name that were not declared.
Haridas argued that this failure to reveal complete information was not just an ordinary mistake, but a
“suppression of material facts.”
According to her, such non-disclosure is a clear violation of the mandatory rules mentioned in the Representation of the People Act, 1951.
The petition further states that due to this incomplete disclosure, the voters were misled.
Haridas alleged that Gandhi
“misled voters through such suppression,”
which she said had an impact on the election results. She further claimed that this act falls under the definition of “corrupt practices” as mentioned under Section 123 of the Representation of the People Act.
In addition to this, Haridas also accused Gandhi of
“exercising undue influence over voters during the campaign.”
She argued that this, combined with the asset disclosure issue, had affected the fairness of the elections. Based on all these grounds, she has requested the Kerala High Court to declare Gandhi’s election from Wayanad as void.
The petition is now officially admitted by the court, and Priyanka Gandhi Vadra is required to respond to the summons. The matter will be further taken up in court in the upcoming month of August.
