Shashi Tharoor criticised the Indian legal system for being overloaded with politically driven, baseless cases. He warned that such cases waste judicial time and turn legal proceedings into punishment itself.

Congress MP Shashi Tharoor has spoken out strongly against the misuse of the Indian judicial system, raising serious concerns about how courts are burdened with cases that he believes are not worth the time of judges.

Speaking to the media in Mumbai on Saturday, Tharoor said that many legal cases being allowed in courts are politically motivated and baseless.

Tharoor made these comments after the Supreme Court reportedly suggested that a BJP leader should consider withdrawing a defamation case filed against him. The case stemmed from a reference Tharoor made in one of his books.

Highlighting the misuse of the judicial process, Tharoor stated,

“The problem in our system is that too many frivolous cases are allowed to function, and then the process itself becomes the punishment. Is the judiciary’s time spent on worthwhile cases, or are many of our judges wasting a significant amount of time on frivolous cases often pursued for political motives?”

He explained the background of the defamation case filed against him, saying it was based on a quote from a 2011 article that he had included in a book. Clarifying his intent, Tharoor said,

“I wasn’t targeting PM Modi. I wasn’t targeting anyone. I had written a book in which I had quoted an article published in 2011, which in turn quoted a statement by an individual in those days in the RSS, who subsequently rehabilitated in the BJP and served as the in-charge of the BJP in eastern UP.”

He further pointed out that the case was filed many years after the book’s publication, implying it was not a timely or justified legal action. Tharoor added,

“I was quoting a quote. So it was not surprising that the Court said to drop the case.”

In addition to speaking about the misuse of legal processes, Tharoor was asked about another issue concerning Congress leader Rahul Gandhi.

Gandhi recently echoed a comment made by former US President Donald Trump, referring to India as having a “dead economy.” However, Tharoor chose not to make any direct comments on Gandhi’s statement.

When asked, Tharoor replied,

“I don’t want to comment on what my party leader has said. He has his reasons for saying so.”

Instead, he shifted focus to India’s diplomatic and economic relations with the United States, underlining their importance.

Tharoor noted,

“My concern is that our relationship with the US, as a strategic and economic partnership, is important for us. We are exporting around 90 billion worth of goods to America. We can’t be in a position to lose that or have it diminish significantly,”

Through his remarks, Tharoor drew attention to two critical issues: the need for judicial reform to prevent the courts from being clogged with politically charged or unnecessary cases, and the importance of maintaining strong ties with global economic partners like the United States.
